Cosby’s Law Team Wants Judge O’Neill to Step Down

Bill Cosby’s defense team has asked Montgomery County Judge Steven O’Neill to recuse himself from Cosby’s upcoming sex assault trial and say they will appeal if he does not step down.

Lansdale attorney Marc Steinberg was a guest on WNPV’s AM Edition Monday morning.

“It’s not really an issue that can be appealed. It’s called interlocutory, which means during the course of a case, it have to something that would be done at the end of it, but that doesn’t necessarily mean that would stop them from trying to appeal it. There just no way that Judge O’Neill is going to step aside in this case.”

The defense asked Judge O’Neill to resuce himself based on his wife’s work with sex assault victims and her financial support of a group that advocates the rights of victims. Cosby is accused of a sex assault on Andrea Constand in 2004 at his Cheltenham Township home. Jury selection starts next week. Pretrial motions will be heard Wednesday and Thursday in Montgomery County Court.
