Same sex marriage is back in the forefront in Montgomery County. Frank Custer, Montgomery County Spokesperson says, the Register of Wills plans to take the next legal step concerning the issuance of same sex marriage licenses.
“The County Solicitor, Ray McGarry, on behalf of the Register of Wills, Bruce Hanes, is going to file an appeal with Commonwealth Court over the next several days. Commonwealth Court will then send the appeal to the Pennsylvania Supreme Court.”
174 same sex couples received marriage licenses since July. The State Health Dept. filed suit against the Register of Wills in July, ordering Bruce Hanes to stop issuing the licenses. The case was brought to Commonwealth Court on September 4th. Commonwealth Court Judge, Dan Pellegrini ruled last Thursday that Hanes did not have the authority to issue the licenses.
