Ex Judge: PSU Suit On Target

penn-state-logoFormer Montgomery County Magisterial District Judge David Keightly says Governor Tom Corbett’s federal lawsuit aimed at overturning sanctions against Penn State University is right on target.

The suit says the sanctions resulting from the Jerry Sandusky child sex abuse scandal are unlawful, and Keightly says the NCAA exceeded its authority in imposing them.

“Their role is exclusive to regulating how college sports are recruited and performed.  For them to get involved in a criminal case like this is unprecedented.  It’s as though a court all of a sudden took jurisdiction of the case where they had no legal authority to do so.”

He says the NCAA simply seized jurisdiction.

“The governor did a very good job in his lawsuit of pointing out the very vague and unspecific grounds that the NCAA used to seize jurisdiction here.  I’ve been a lawyer for a long time and I’ll be darned if I can see how it gave them the authority to do what they did.”

Keightly, who is now in private law practice, says none of the lawyers he’s discussed it with think there’s any justification for what the NCAA did, and he believes it’s preposterous.  He appeared Thursday on the WNPV talk program Comment Please by Univest.
