Montgomery County officials were prepared to issue a marriage license to a same sex couple. Register of Wills, Bruce Haines says the application was submitted last week. He and county attorneys reviewed the state law and comments from state attorney General Kathleen Kane, who says she believes the state ban on same sex marriage is unconstitutional. In a statement released yesterday by Haines, He said he decided to come on down the right side of history and issue the first same sex marriage license in county history. However, the two women seeking the license decided to withdraw their application. Sources say it might have been at the request of the A.C.L.U. ,which is in court seeking to overturn the state’s ban on same sex marriage.
