The issue of same sex marriage in Montgomery County has more legal hurdles before it, after Commonwealth Court granted the State’s request for an expedited process, giving the State Health Dept, until August 12th to file a brief. County spokesman Frank Custer says the county will then have until August 19th to file a response.
“After that, the court will either schedule hearings or will issue an order based upon the briefs.”
Custer adds, Commonwealth Court has not ordered the county to stop issuing same sex licenses.
“We continue to issue licenses to any eligible couple who wants a marriage license.”
Montgomery County has issued 78 licenses to same sex couples, a number that is likely to increase before the court can make a ruling.
